Public Comment Period for Emergency Rulemaking Action Related to Cannabis Cultivation Licensing

On Monday, November 27, 2017, the California Department of Food and Agriculture (CDFA) submitted its emergency rulemaking action related to cannabis cultivation licensing to the Office of Administrative Law (OAL). The public comment period for submitting comments to OAL for these emergency regulations will end on Monday, December 4, 2017. 

Those who wish to comment on the proposed adoption of the emergency regulations for medicinal and adult-use (recreational) cannabis cultivation must submit their comments directly to OAL on their website.

When you submit a comment to OAL, you must simultaneously submit a copy of your comment to CDFA. 

CDFA’s email address for public comments is: CalCannabisRegs@cdfa.ca.gov

OAL will confirm that CDFA has received the comment before considering it. Pursuant to California Code of Regulations, Title 1, section 55(b)(1) through (4), the comment must state that it is about an emergency regulation currently under OAL review, and include the topic of the emergency.

Adoption of emergency regulations does not require CDFA to respond to comments. Any responses to comments from CDFA will be submitted to OAL within eight calendar days following the date of submission of the proposed emergency regulations to OAL, unless specific exceptions are applicable.
