Senate Bill 540 (SB 540, Chapter 491, Statutes of 2023) requires the Department of Cannabis Control to consult with the Department of Public Health, and develop a single-page brochure to be displayed and offered to consumers. FAQ: Providing and displaying the consumer brochure 

Q: Who is required to provide the brochures to consumers? 

A: All licensed retailers, including storefront and delivery, are required to provide the brochure to new consumers.  This includes licensed microbusinesses with listed retail activities.   

Q:  What are the requirements for displaying and providing the brochures? 

A:  The brochure must be offered to each new consumer. The brochure must also be prominently displayed: 

• Online at the time of online purchase

• At the point of sale or final delivery in person, including printed copies

Q: Who’s responsible for printing the brochures? 

A: It is the responsibility of the licensee to print and provide the brochures to first time consumers.    

Q: What are the requirements for printing the brochure? 

A: The brochure must be printed in a type size not smaller than 12 points and on one side of a standard 8 ½” x 11” piece of paper. Licensees may print ad provide the black and white or color version of the brochure.   

Q: Can I add content to the blank side of the brochure? 

A: The brochure cannot be altered in any way. The blank side of the brochure must remain blank.  No images, marketing, advertising, or other information can be added to either side of the brochure.  

Q: How do I display it online? 

A: Licensees must display a full-size image of the brochure, in a type size no smaller than 12 points, online at the time of online purchase. Embedded links to the brochure or images smaller than the full-size brochure are not permitted. 

Q: How do I know if they’re a new consumer? 

A: Individuals are considered a new consumer if it’s their first time purchasing at your store.
